ENCROACHMENT PERMITS

 

An encroachment permit must be obtained prior to commencement of any activities affecting the public right-of-way (the area of the public sidewalk, parkway, and roadway). These activities include, but are not limited to excavation, street/sidewalk/driveway/curb/gutter improvements, utility work, sewer lateral repairs, water meter installations, street/sidewalk closures, traffic control, unloading/loading of construction materials, temporary utilization of construction equipment or material, temporary barricades and scaffolding, on-street parking for work vehicles, construction debris container staging, etc. An encroachment permit allows for an activity within the City’s public right-of-way to be reviewed for safety compliance and allows for the restoration of public infrastructure to be monitored. Please refer to links at the bottom of the page for standard restoration details.

The City of West Hollywood DOES NOT ALLOW the following items/activities in the public right-of-way:

  • Moving/storage containers
  • Construction trailers/portable offices
  • Porta-potties
  • Overnight storage of construction vehicles/equipment such as cranes, lift equipment, concrete pumps, excavators, etc. (The City Engineer may review appeals of a critical nature and/or extreme circumstances).
  • Overnight storage of construction materials such sand, gravel, pipes, etc. (The City Engineer may review appeals of a critical nature and/or extreme circumstances).

Please submit encroachment permit applications well in advance of requested start dates. As soon as an encroachment is desired, an application should be submitted, to ensure enough time has been provided to obtain approval of the multitude of documents needed for an encroachment permit issuance.  Typical review time for each submission, and each follow-up submission, is around 10 business days each. Please note that incomplete submittals will not obtain encroachment permit issuance. Complex requests, such as but not limited to those requiring full or partial closure of the sidewalk/roadway areas, may require several review cycles to be granted approval. Please note that encroachment permit applications where applicants do not respond to correction comments for two weeks will be cancelled due to inactivity, so that other applications can be progressed. 

Once a permit has been issued, applicant can obtain parking signs at the automated parking garage located behind City Hall with proof of permit. Please plan for ample time to pick up, post signs, and call Parking Enforcement to verify. “No Parking” signs must be up and verified at least 72 hours in advance of planned start.

Please provide all requested information and documents in the permit application. Failure to do so may result in delays or denial of your application. The following documents are examples of documents typically required to be submitted:

  • Certificate of Insurance (Add the City of West Hollywood as additional insured)
  • Contractor License (Class A is acceptable for most work in the public right-of-way)
  • City Business Tax Certificate
  • Traffic Control Plan
  • Construction Plan.

***Pleased be advised, on December 2, 2024, the city launched its new City of West Hollywood Permitting and License Portal (EP&L). On this date, the links on Engineering’s website were updated, and all new encroachment applications will be submitted via EP&L. Applications initiated and in review prior to the December 2nd date will be completed within the previous system and there will be no need to reapply in EP&L. This update will only affect new encroachment applications submitted on and after December 2, 2024.***
