If you do not already own property in the city, welcome to West Hollywood! Whether this is your first property in the city or you already own a rental, we would like to share some important information with you about renting residential property in the city. As a property owner, it is important you review your rights and responsibilities. The following information along with other helpful resources is available online at www.weho.org/rsd.

TENANCY PROTECTIONS APPLY TO ALL, REGARDLESS OF BUILDING TYPE OR AGE.

All residential tenancies in West Hollywood, regardless of building age, are subject to the following sections in Title 17 of the West Hollywood Municipal Code:

17.30 Tenant Protection During Construction. Property owners must abide by habitability requirements when undertaking renovation or other forms of construction. For certain projects, a tenant habitability plan is required. Information is available at www.weho.org/rsd.

17.52 Permissible Reasons for Permanently or Temporarily Terminating or Refusing to Renew Tenancy. Tenants are protected from eviction without just cause. Just cause includes not paying rent or causing a nuisance, among others.

Leases convert automatically to month to month following the initial lease term, unless you require renewal prior to end of the current lease term.

UNITS THAT RECEIVED CERTIFICATE OF OCCUPANCY BEFORE JULY 1, 1979 ARE SUBJECT TO THE FULL RENT STABILIZATION ORDINANCE (WHMC CHAPTER 17). 

New tenancies must be registered within 30 days. You may do this online. Information on obtaining a PIN and password is here: www.weho.org/rsd.

The annual registration fee is $144/unit ($60 for Section 8 tenancies) and is due July 15 of each year. Your bill will be sent to the mailing address you provided through your property registration or Property Information Update form. You can pay the annual fee online via the Landlord Portal.

Monthly fee pass-through to tenants: $6 can be passed through each month to each unit once the annual fee is paid (no pass through for Section 8).

Rent increases after move-in are limited to the Annual General Adjustment (AGA). Rent can be increased 12 months after your tenant moves in, then once every 12 months thereafter. The allowable rent increase is effective from September 1 to August 31 of each year. An allowed rent increase that is not applied is in effect lost.

Property owners must maintain housing services provided with the tenancy. When you register a new tenancy, you must provide information on the services provided with that tenancy. In addition, any service otherwise provided when a tenant moves-in is also considered part of the lease terms. If a housing service is later removed or no longer provided, your tenant can petition for reduced rent to compensate for the loss of that housing service.

Minimum maintenance required: Interior walls, living areas, and common areas must be painted every four years. Exterior building walls must be painted every seven years. Carpets, linoleum, and blinds must be replaced every seven years.

Property owners must notify the City when ownership changes.

Property owners also notify the City before owner-occupying a unit & when moving out of an owner-occupied unit.

Rental properties in West Hollywood are required to be registered with the City. Landlords can register their properties through the online landlord portal.  For owners of single-family dwelling or condo rentals, please visit our Non-Rent-Controlled Registry page for more information.

UNIT RE-REGISTRATIONS

Units must be re-registered with the City after vacant rental units are filled. Registrations must be submitted within 30 days from the move-in date and can be submitted through the online landlord portal.

Please note that re-registrations only need to be submitted once for each tenancy.  A unit should only be re-registered after all tenants on the prior registration have vacated the unit.  Any unit re-registrations submitted for the same tenancy after it was already re-registered will be considered a duplicate and will be rejected. If you are uncertain if a unit has been re-registered for the current tenancy, please contact Rent Stabilization at rsd@weho.org or (323) 848-6450 and we will check our records for you.

Please also note that if a current tenancy began prior to 1/1/1996, no re-registration should be filed as the re-registration requirement was not in effect at the time the tenant(s) moved in. Any re-registration submitted for a tenancy that began prior to 1996 will be rejected.
