The City of West Hollywood’s Rent Stabilization Division developed instructional videos for landlords on how to register Non-Rent Controlled properties and units in the city’s online Landlord Service Portal. You can access these videos below:
As you may be aware, all rental properties that are subject to rent limits under the City of West Hollywood’s Rent Stabilization Ordinance (“RSO”) are currently required to be registered with the City. In addition, any time a rent stabilized unit is re-rented following a vacancy, the landlord is required to re-register that tenancy, providing relevant information such as the name of the tenant, unit number and initial rent.
On February 22, 2022, the City Council of the City of West Hollywood adopted Ordinance No. 22-1177, which added Section 17.28.050 to the West Hollywood Municipal Code.
Section 17.28.050 requires that, beginning in 2023, most properties with rental units that are not subject to rent limits under the RSO also follow the registration and re- registration process. You have received this notice because your property has been identified as potentially being subject to the new requirements.
If your property is a for-profit, multi-family residential rental property built after July 1, 1979, then your property is subject to the new registration and re-registration requirements of Section 17.28.050 beginning in 2023. If you own a single-family residence or condominium and rent the property, and do not occupy the property yourself, then your property is also subject to the new registration and re-registration requirements. Single-family residence and condominium owners who currently occupy their property, even if they rent out portions of the property to boarders at this time, are not subject to the new requirements but will have an ongoing obligation to alert the City to any change in the rental status of their property.
A mailer was sent out with instructions on how to utilize the City’s online registration portal which will allow you to create your account and perform the initial registration of your property, if required.
All landlords required to comply with the registration requirements will be invoiced the annual registration fee beginning in May 2023. The current registration fee is $144.00 per registered rental unit, subject to change by the City Council. Once paid, landlords may pass-through one-half of the registration fee as a monthly prorated surcharge (currently $6.00) to their tenants. The registration fee is utilized to offset the cost of services that in many cases are already available to non-rent stabilized tenants and landlords, including no-cost mediation, relevant tenancy-related forms, information services and administrative assistance.
If your property is subject to registration, and you fail to register as required, you may be subject to fines and penalties beginning at $1,000.00 per violation.
